AC21 Job Portability - Changed Jobs After 180 Days

Used AC21 to change jobs while I-485 was pending. Here's what you need to know.

What is AC21? After 180 days of I-485 pending, you can change jobs without affecting your green card if:

  • New job is same or similar occupation
  • I-140 was approved (or 180+ days pending)

My situation:

  • I-485 filed: January 2025
  • 180 days: July 2025
  • Job change: August 2025
  • GC approved: October 2025!

How I did it:

This is exactly what I needed! I'm about to hit 180 days and considering a job change. The new company is offering more pay and better role. Good to know AC21 works well.

Did you inform your old employer that you're using AC21? Or just left without mention of immigration?

@nikhil_pd_current I didn't specifically tell my old employer I was using AC21. Just gave normal 2-week notice and resigned professionally. They knew I had I-485 pending but I didn't make a big deal about the immigration angle.

From old employer's perspective, they have no obligation to you after you leave. The I-140 was already approved and won't be revoked after 180 days of I-485 pending.

Just make sure you have EAD to work for the new employer!
