I-485 Pending - Can I travel on Advance Parole?

My I-485 has been pending for 6 months and I received my combo card (EAD + AP). My grandfather is very sick in Mexico and I need to travel urgently.

Questions:

  1. Is it safe to travel on AP while I-485 is pending?
  2. What documents should I carry?
  3. Are there any risks at the port of entry?
  4. How long can I stay outside the US?

I've heard horror stories about people having issues at the border. My H1B is still valid - should I use that instead?

Really need advice from people who have travel...

I've traveled on AP 3 times with no issues. Key things:

  1. YES it's safe if your case is solid
  2. Bring: AP card, I-485 receipt, I-140 approval, employment letter
  3. At the border, go to the regular line, show AP, answer questions briefly
  4. Stay time - I'd recommend keeping trips under 30 days

Since your H1B is valid, you technically have two options. But if you use H1B to travel and re-enter, you maintain H1B status. If you use AP, you enter as parolee. Just pick one and stick with it.

I traveled on AP to India while my I-485 was pending. No problems at POE (San Francisco). The CBP officer was very matter-of-fact about it. I was nervous for nothing!

For your grandfather, definitely go. Family is important. Just make sure your AP document covers your entire travel period.
