Surviving H1B Specialty Occupation RFE - What Worked

I've been through 2 H1B RFEs for specialty occupation and won both. Here's what I learned.

Why RFEs happen:

  • Vague job description
  • Job title doesn't clearly require a degree

The expert opinion letter is clutch. For anyone reading this - don't cheap out on this. Pay the $1,000-2,000 for a good professor who actually understands immigration law requirements.

The letter should:

  1. Explain why the specific job duties require a specific degree
  2. Include the professor's credentials
  3. Reference industry standards
  4. Be at least 5-10 pages with detailed analysis
