RFE for H1B Specialty Occupation - How to respond?

Just received an RFE for my H1B extension. USCIS is questioning whether my job qualifies as a specialty occupation. I'm a Software Engineer with a Bachelor's in Computer Science.

The RFE asks for:

  1. Evidence that the position requires a bachelor's degree in a specific specialty
  2. Detailed job duties and how they relate to my degree
  3. Industry standards for similar positions

I got the exact same RFE! The specialty occupation RFE is so common now. You NEED an expert opinion letter - that's what saved my case. Find a professor from a reputable university in your field who can write a detailed letter explaining why the job requires specialized knowledge.

Also, make sure your job description in the RFE response is SUPER detailed. Break down every duty and show how it requires your specific degree.

Seconding the expert letter recommendation. Mine cost $1,500 but it was worth every penny. Also include job postings from similar companies showing they require CS degrees for similar roles.

Don't panic! These RFEs are very winnable. The key is being over-prepared. I've helped colleagues through 3 of these RFEs and all were approved. Your attorney should know how to handle this.
